Terms of Service
Please read these Terms carefully — they govern your use of the StarBrain mobile app.
1. Acceptance of terms
These Terms of Service (“Terms”) form a binding agreement between you and Apparent Group Limited (“we”, “us”) governing your use of the StarBrain mobile app and any related services (collectively, the “Service”). By creating an account or otherwise using StarBrain, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to use StarBrain. By using StarBrain you confirm that you meet this requirement and that you have the right and authority to enter into these Terms.
3. Account registration
Some features require an account. You agree to provide accurate registration information, to keep your password confidential, and to be responsible for activity that occurs under your account. Notify us promptly at hello@apparentgroup.co if you suspect unauthorised use.
4. Licence to use the app
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use StarBrain on devices you own or control, for non-commercial use. You may not copy, modify, reverse-engineer, resell, or sublicence the Service except as permitted by applicable law.
5. Your content
You retain ownership of the photos and notes you submit to StarBrain (“Your Content”). You grant us a limited licence to host, process, and display Your Content solely to operate the Service for you (for example, running card identification on a photo you scan and storing the result in your collection). We do not use Your Content for advertising, model training, or any unrelated purpose without your explicit consent.
6. Identification accuracy and valuations
StarBrain provides card identifications, condition estimates, and market value estimates for informational and hobbyist purposes only. Outputs are produced by automated systems and third-party data sources and may be inaccurate, incomplete, or out of date. StarBrain is NOT a substitute for professional appraisal, grading, or financial advice. Decisions to buy, sell, insure, or otherwise act on a card based on StarBrain's output are made entirely at your own risk.
7. Subscriptions, billing, and refunds
StarBrain offers optional paid subscription plans. Subscriptions are sold and billed through the app store you downloaded the app from (Apple App Store or Google Play). Prices, renewal terms, and free-trial details are shown in-app before purchase. Subscriptions renew automatically until you cancel them through the app store's subscription management screen. Refunds, where available, are handled by the app store under its standard policy.
8. Prohibited activities
You agree not to: (a) use StarBrain to infringe anyone's intellectual property, privacy, or other rights; (b) upload unlawful, harmful, harassing, or sexually explicit content; (c) attempt to gain unauthorised access to other accounts or to our systems; (d) interfere with the operation of the Service; (e) use the Service to build or train a competing product; or (f) use automated systems to scrape or extract data from the Service.
9. Intellectual property
The StarBrain app, brand, logo, design, and underlying software are owned by Apparent Group Limited and protected by intellectual-property laws. Except for the limited licence above, no rights are granted to you by implication or otherwise.
10. Third-party services
StarBrain integrates with third-party services (for example, Google Firebase for authentication and storage, and the Apple/Google billing systems). Your use of those services is subject to their own terms and privacy policies, which we do not control.
11. Termination
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you breach these Terms, if doing so is necessary to comply with law, or if the Service is discontinued. On termination, your rights under these Terms end immediately; sections that by their nature should survive (for example, disclaimers and limitation of liability) will continue to apply.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of identification or valuation. We do not warrant that the Service will be uninterrupted, error-free, or that any defects will be corrected.
13. Limitation of liability
To the maximum extent permitted by law, Apparent Group Limited and its officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of or relating to your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose, or USD 50 if you paid nothing.
14. Governing law and disputes
These Terms are governed by the laws of Hong Kong, without regard to its conflict-of-laws rules. The courts of Hong Kong have exclusive jurisdiction over disputes arising out of or relating to these Terms, except where mandatory consumer-protection laws of your country of residence say otherwise.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be flagged in the app and the effective date above will be bumped. If you continue to use StarBrain after a change becomes effective, you accept the updated Terms. If you do not accept, please stop using the Service.
